ASBSMS CONSTITUTION -
BYLAWS

|
ARTICLE
ONE-STUDENT COUNCIL
The name of
the organization shall be the Associated Student Body of
Sunnyvale Middle School (ASBSMS).
This
organization shall have as its purpose, the conduct of
activities on behalf of the students of Sunnyvale Middle
School as approved by the school principal and the Sunnyvale
School District Board of Education.

ARTICLE
TWO -EXECUTIVE BOARD
The
executive board shall consist of the following the
Associated Student Body of Sunnyvale Middle School
officers:
- President.
The ASBSMS President shall have the following
duties:
- Preside
over all meetings of the Associated
Student Body of Sunnyvale Middle School
Representatives
Council.
- Call
special meetings of the Associated
Student Body of Sunnyvale Middle School
Representatives
Council.
- Plan
and prepare an agenda for the meetings
of the Associated Student Body of
Sunnyvale Middle School Representatives
Council.
- Appoint
all committee members and
chairpersons.
- Serve
as ex-officio member of all
committees.
- Represent
the Associated Student Body of
Sunnyvale Middle School at all school
and Sunnyvale School District meetings
where a representative is required or
appropriate.
- Preside
over all student body assemblies or
authorize someone to do so in his/her
place.
- Vote
in the Associated Student Body of
Sunnyvale Middle School Representatives
Council meetings only where his/her
vote would affect the
result.
- Serve
as one of the two student
representatives to the School Site
Council.
- Prepare
and deliver the Student Report to the
Sunnyvale Middle School Parent Teacher
Student Association.

- Vice-president.
The ASBSMS Vice-president shall have the
following duties:
- Serve
as the ASBSMS president if the
president is permanently or temporarily
unable to perform his or her
duties.
- Serve
as alternate for either of the two
student representatives to the School
Site Council.
- Serve
as chairperson of the Elections
Committee.
- Perform
all duties assigned by the President of
the Associated Student Body of
Sunnyvale Middle
School.

- Treasurer.
The ASBSMS Treasurer shall have the following
duties:
- Maintain
complete and accurate record of all
Associated Student Body of Sunnyvale
Middle School receipts and
disbursements.
- Serve
as the Chairperson of the Finance
Committee with the assistance of the
Sunnyvale Middle School Leadership
Advisor, the Sunnyvale Middle School
ASB Bookkeeper, and the Sunnyvale
School District ASB Finance
Officer.
- Serve
as one of the two student
representatives to the School Site
Council.
- Prepare
monthly reports for the Associated
Student Body of Sunnyvale Middle School
on bank balances and disbursements to
date.
- Keep
accurate profit and loss statements of
all Associated Student Body of
Sunnyvale Middle School functions and
assist clubs and activities in
keeping
- Supervise
the preparation of the annual
Associated Student Body of Sunnyvale
Middle School Budget.

- Secretary.
The ASBSMS Secretary shall have the following
duties:
- Maintain
accurate minutes of each meeting of the
Associated Student Body of Sunnyvale
Middle School Representatives
Council.
- Before
the next scheduled meeting, distribute
draft copies of the minutes of each
meeting so that they can be reviewed
and approved at the
meeting.
- Record
and distribute an agenda for each
scheduled meeting of the Associated
Student Body of Sunnyvale Middle School
Representatives
Council.
- Carry
out all necessary correspondence for
the Associated Student Body of
Sunnyvale Middle
School.

Activities.
The ASBSMS Commissioner of Activities
shall have the following
duties:
- Coordinate
and maintain the master
calendar of all Associated
Student Body of Sunnyvale
Middle School
activities.
- Serve
as chairperson of the
Activities
Committee.
|
|
Athletics.
The ASBSMS Commissioner of Athletics shall
have the following duties:
- To
initiate and organize
the intramural
sports.
- To
assist the Athletic
Director for Sunnyvale
Middle School with the
After-School Sports
Program.
- Report
results of Sunnyvale
Middle School
participation in After
School Sporting Events
to the student
body.

Academics.
The ASBSMS Commissioner of Academics shall
have the following duties:
- Serve
as the student
representative from
Sunnyvale Middle School
at all District meetings
requiring student
representation.
- Publicize
participation and
achievements of all
extra-curricular
academic events
involving students from
Sunnyvale Middle
School.
- Coordinate
and supervise the
Spartan Citizenship
program.
- Coordinate
and organize the
Renaissance recognition
assemblies.

Publicity.
The ASBSMS Commissioner of Publicity shall
have the following duties:
- Publicize
all school activities
through the school
marquee, daily bulletin,
monthly newsletter,
school bulletin boards,
and Spartan TV
programs.
- Issue
news releases approved
by the school principal
to local press, radio,
and television
stations.

The
Executive Board shall have all executive powers.
The Executive Board members shall serve as voting
members of the Associated Student Body of Sunnyvale
Middle School Representatives
Council.
Duties
and responsibilities of the Executive Board members
are described in the By-laws to the
constitution.
The
positions on the Executive Board shall be filled by
a general election of the Associated Student Body
of Sunnyvale Middle School annually during the
fourth academic quarter.
Executive
Board Members shall hold office for one academic
year beginning the first scheduled day of class as
determined by the Sunnyvale School District.
Executive Board Members will be enrolled in the
Leadership Elective for the entire academic
year.
No
member of the Executive Board may hold more than
one the Associated Student Body of Sunnyvale Middle
School Office.

ARTICLE
THREE-STANDING COMMITTEES
The
Associated Student Body of Sunnyvale Middle School president
and the Associated Student Body of Sunnyvale Middle School
advisor shall appoint committee members and chairpersons to
the following committees each year no later than the Friday
immediately following the Labor Day Holiday.
- The
Finance Committee
- The
ASBSMS Treasurer shall chair the Finance
Committee.
- The
ASBSMS advisor, one representative from each
grade chosen by the elected student council
representatives from that grade, the ASBSMS
bookkeeper, and each grade level team leader
shall serve on this
committee.
- The
purposes of the committee is to prepare and
submit the final budget, approve all requests
to conduct ASB fund raising activities, and
review all expenditure requests approved by
the ASBSMS student council.

- The
Elections Committee
- The
ASBSMS vice-president shall chair the
Elections Committee.
- The
ASBSMS advisor and one representative from
each grade chosen by the elected student
council representatives from that grade shall
serve on this committee.
- The
purpose of this committee is to plan,
organize, and supervise all student body
elections.
- Acts
as screening committee for all candidates to
determine if they meet
qualifications.

- The
Activities Committee
- The
ASBSMS Activities Commissioner shall chair
the Activities Committee.
- The
ASBSMS advisor and two representatives from
each grade chosen by the elected student
council representatives from that grade shall
serve on this committee.
- The
students in the Leadership Elective shall be
non-voting associate members of the
activities committee and provide the primary
work force for producing and supervising each
activity.
- The
purpose of this committee is to plan,
organize, and supervise all student body
activities approved by the ASBSMS Student
Representative Council.

ARTICLE
FOUR-SUCCESSION
If the
ASBSMS president cannot fulfill his/her duties due to
illness, injury, or absence the ASBSMS vice-president shall
assume and carry out the duties of ASBSMS president until
the ASBSMS president becomes able to resume his/her
duties.
If the
ASBSMS president is permanently unable to fulfill his/her
duties due the ASBSMS vice-president becomes the ASBSMS
president.
The ASBSMS
vice-president shall be replaced during the first semester
by a special election conducted by the Elections Committee.
If the ASBSMS vice-president needs replacement during the
second semester, the ASBSMS Student Council Representatives
will select a replacement from the students in the
Leadership Elective.

ARTICLE
FIVE-ELECTIONS AND QUALIFICATIONS FOR
OFFICE
The
positions on the Executive Board shall be filled by a
general election of the Associated Student Body of Sunnyvale
Middle School on the first Thursday after Memorial
Day.
The five
representatives from each grade level for the first semester
shall be chosen by grade level election on the first
Thursday after Labor Day.
The five
representatives from each grade level for the second
semester shall be chosen by grade level election on the
first Thursday after Martin Luther King Day each
year.

Qualifications
for candidates for ASBSMS elected
office:
- Minimum
grade point average of 2.5
- At
least an "S" in Citizenship and Work habits for
the previous three quarters
- Participate
in Renaissance program at some
level.
- Endorsement
by their grade level administrator and two of
their teachers
- First
semester 6th grade candidates will
use 5th grade GPA and Citizenship and
Work Habits evaluations.
- Candidates
for Executive Board positions shall also apply
for the Leadership Elective the following
year.

The
Campaign:
- Candidates
may begin their campaign on the Thursday prior
to Election Day.
- Candidates
are not allowed to distribute campaign buttons,
stickers, or sundry items promoting their
election.
- Candidates
may place up to eight posters on campus. The
posters may not exceed two foot by two
foot.
- Candidates
may place small posters in classrooms if the
classroom teacher gives permission. The small,
classroom posters may not exceed 8.5 inches by
11 inches.
- Candidates
will prepare a 2-3 minute speech for broadcast
over Spartan TV the Wednesday prior to
election.
- Candidates
will be introduced at a lunchtime rally the
Thursday prior to election.
- Candidates
are responsible for removing all campaign
materials from campus after election results are
announced.
- Candidates
must have the approval of the Elections
Committee before posting any campaign material
or conducting any campaign
activities.

Counting
the Ballots:
- The
ASBSMS president and the Elections Committee
shall count the ballots on the same day as the
election is held. No candidate for office may
participate in the counting of
ballots.
The
ballots shall be counted twice and the results
compared. A third count is required if the results
of the first and second counts are not within 1
percent of each other.

Announcing
the results:
- Prior
to announcement, all candidates shall be
gathered together and the results made known to
them before announcing to the student
body.
- The
ASBSMS president shall announce the results to
the student body immediately after notifying the
candidates of the results.

|
ARTICLE
SIX-STUDENT CLUBS
Students
may form clubs to conduct regular activities when they meet
the following conditions:
Shall have a membership of at least five active
participating students.
Must
meet regularly at least twice a month.
Shall have a Charter describing their
purpose.
- The
School Principal must approve the Charter
annually by the 4th week of school
each year.
- The
club must have a faculty representative
designated by the School
Principal.
Shall have a constitution approved by their membership
before it can begin fund-raising activities or make
expenditures of club funds.
Shall prepare a proposed budget of expenditures and fund
raising by the end of the School Year.

ARTICLE
SEVEN-AMENDMENTS
The
Associated Student Body of Sunnyvale Middle School
Representatives Council, whenever it is necessary, shall
propose amendments to the constitution. To make such
amendments valid, the Associated Student Body of Sunnyvale
Middle School must approve by a two-thirds vote in a general
election.

ARTICLE
EIGHT-FINANCES
The student
council must approve all requests for expenditures of all
student funds prior to any commitments.
Student
Clubs must have a positive balance in their club account
before the Associated Student Body of Sunnyvale Middle
School Representatives Council may approve
expenditure.
Associated
Student Body of Sunnyvale Middle School Activity Fund
Authorization of Payment requires the approval of the ASB
Treasurer, the ASB Advisor, and the School
Principal.
Procedures
for financial transactions will comply with current
Sunnyvale Elementary School District policies and
procedures.

ARTICLE
NINE-MEETING SCHEDULES
The ASBSMS
Student Council shall meet at least twice each month on the
first and third Thursday during the scheduled meeting time
of the Leadership Class elective and for special sessions,
as called by the ASBSMS president or the ASBSMS
advisor.
The ASBSMS
President shall conduct the student council meetings using
the parliamentary procedures guidelines used in the
Leadership Elective curriculum.
The Finance
Committee shall meet each Thursday at lunchtime and at other
times as called by the ASBSMS president or the ASBSMS
advisor.
The
Elections Committee shall meet monthly as called by the
ASBSMS president or the ASBSMS advisor.
The
Activities Committee shall meet each Tuesday at lunchtime
and at other times as called by the ASBSMS president or the
ASBSMS advisor.

ARTICLE
TEN-ADOPTION
Annually,
the Principal of Sunnyvale Middle School with the advice of
the Associated Student Body of Sunnyvale Middle School
advisor shall approve for implementation these By-laws
before the first scheduled day of class each year as
determined by the Sunnyvale School District.
